May I download an essay licensed for the ULB Darmstadt and make it available to my students in a Moodle course?

Scenario:

Professor Musterfrau would like to make the paper “Optimizing Echo State Networks for Static Pattern Recognition” from the journal “Cognitive Computation” available to her students as a pdf file via Moodle. The article is licensed for the ULB and is offered to the TU members via the Electronic Journals Library.

Answer:

Professor Musterfrau may only place a hyperlink to the licensed journal in her Moodle course. Downloading and subsequently making available (also via e-mail, USB stick, etc.) is not permitted.

Legal Considerations

Set Hyperlink

If a user licence has been acquired by the ULB for the relevant journal, it can be referred to by setting a hyperlink in the corresponding Moodle course. The students can thus (under certain circumstances after establishing a VPN connection) also access the journal from home via the Electronic Journals Library.

Downloading and posting not allowed

Downloading and subsequent uploading or making available on websites, learning platforms, cloud services, etc. by teachers and students is not permitted. Passing on to third parties in printed form is also not permitted.

Use according to § 60a UrhG, if there is no license by ULB

If there is no license from the ULB, you can use the options under § 60a UrhG instead.
